The Respondent, however, failed to follow the mandatory redundancy procedure under Section 40 of the Employment Act, as there was no evidence that employees were properly notified or that the criteria for redundancy were applied. Consequently, the termination was procedurally unfair and unlawful. The Claimant was not entitled to the large sum claimed as terminal dues, but was entitled to service pay for four years (less amounts already paid) and compensation for unfair...
