The court held that it lacked jurisdiction to entertain the election petition or any interlocutory applications prior to the proper constitution of the election court. Proper constitution requires the designation of a judge by the Chief Justice and publication of the judge's name in the Gazette and a national newspaper, as stipulated by Rule 6 of the Elections (Parliamentary and County) Petition Rules, 2017. Any proceedings undertaken before these requirements are fulfilled are a nullity for want of jurisdiction.
