The Respondent's opposition, based on financial incapacity and potential prejudice to its members, was found untenable as the decree remains unchallenged and unsatisfied. The Tribunal held that the requirements for garnishee proceedings under Order 23 of the Civil Procedure Rules were met, as the Garnishee is indebted to the judgment debtor. Therefore, the Decree Holder's application for attachment of the funds was merited and allowed.
