Ratio Decidendi

The court found that the plaintiff entered into a valid agreement for the purchase of a portion of land from the 1st defendant in 1982, paid the full purchase price, and took possession of the land, developing and occupying it continuously since then. Although the sale became void for want of Land Control Board consent, a constructive trust arose in favour of the plaintiff, and his possession constituted an overriding interest. By the time the 1st defendant transferred the land to the 2nd defendant in 2004, the plaintiff's adverse possession had already extinguished the 1st defendant's title. The transfer to the 2nd defendant was therefore ineffectual, as the plaintiff had acquired title...
