The Tribunal found that the complainant's evidence, corroborated by the Returning Officer and the decision of the Special County Appeal’s Tribunal, established that he was the rightful nominee for the position of Member of County Assembly, Umoja II Ward. The respondents failed to participate or provide any rebuttal. The 3rd Respondent's issuance of the nomination certificate to the 1st Respondent was not justified. On a balance of probabilities, the complainant's fears were well founded, and the complaint was merited. The Tribunal therefore ordered the 3rd Respondent to issue the nomination certificate to the complainant and nullified the certificate issued to the 1st Respondent.
