Ratio Decidendi

The court found that the applicant failed to satisfy the mandatory pre-conditions for setting aside the order of stay. There was no appeal from the order of stay of 20th April 2007, no evidence of substantial loss to the applicant if the order was not made, and no security was offered for the due performance of any decree or order. The motor vehicle was already secured at the police station pending the appeal, negating the risk of vandalism. Consequently, the application for review and stay was dismissed as the applicant did not meet the legal requirements under the Civil Procedure Rules.
