The Court of Appeal found that although the delay in filing the Notice of Appeal and Memorandum of Appeal was inordinate, it was sufficiently explained by the applicant's advocate. The court also noted that the intended appeal was not frivolous as it raised substantial legal issues regarding the High Court's jurisdiction to enhance the sentence under its revisionary powers. In the interest of justice, and considering that the respondent did not oppose the application, the court exercised its discretion to allow the application and extend the time for filing the necessary appeal documents.
