Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the conviction for manslaughter was supported by cogent and reliable evidence.
  2. 2 Whether the sentence of life imprisonment was manifestly excessive in the circumstances.

Ratio Decidendi

The High Court found that the conviction for manslaughter was supported by cogent, reliable, and corroborated evidence. The appellant was seen stabbing the deceased by two eyewitnesses, was arrested near the scene with a knife, and forensic evidence confirmed the blood on the knife matched the deceased. The appellant's defence was found to be unconvincing and did not address the prosecution's evidence. However, the court held that the sentence of life imprisonment was manifestly excessive in the circumstances, and a deterrent sentence of 25 years imprisonment was more appropriate, to run from the date the plea was taken at the trial court.

Court Disposition

Appeal against conviction dismissed; appeal against sentence allowed in part.

Orders

  • The conviction for manslaughter is upheld.
  • The sentence of life imprisonment is set aside.
