The court held that the original plaint was filed by an advocate who did not possess a valid practicing certificate, rendering the plaint incompetent ab initio. The subsequent amendment of the plaint by a qualified advocate did not cure the defect, as the amended plaint is not a fresh pleading but merely incorporates changes into the original, defective plaint. The law under Section 9 of the Advocates Act and binding Court of Appeal authority is clear that pleadings filed by unqualified persons are a nullity and must be struck out. The court therefore struck out the entire suit for want of competence, as there was no valid plaint before the court.
