Procedural Posture

Miscellaneous Application / Ruling on Enforcement of Public Service Commission Decision and Reinstatement Application

  1. 1 Whether the decision of the Public Service Commission directing reinstatement of the applicant should be recognized and enforced as a judgment of the court.
  2. 2 Whether the applicant is entitled to reinstatement and payment of salary arrears following the PSC decision.
  3. 3 Whether the pendency of a review application before the PSC bars enforcement of the PSC decision.

Ratio Decidendi

The court found that the only ground for opposing the application was the alleged pendency of a review application before the Public Service Commission. However, the PSC had already dismissed the review application for lack of new material facts, as evidenced by the letter dated 14th July, 2021. With the review application no longer pending, there was no legal impediment to enforcing the PSC decision. The court therefore allowed the application, recognizing and adopting the PSC decision as a judgment of the court and ordering the applicant's reinstatement and payment of salary arrears.
