The court held that since the plaintiffs themselves admitted the suit was filed out of time and had not prosecuted their application for extension of time, there was no valid suit before the court. The existence of a valid suit is a prerequisite for the grant of a temporary injunction. Without a competent suit, the court lacks jurisdiction to grant interim relief. The application for temporary injunction was therefore struck out, and all interim orders previously granted were discharged.
