In the absence of such evidence, the Plaintiff's claim of fraudulent acquisition was not frivolous. The court held that the Plaintiff had established a prima facie case with a probability of success, and that unless injunctive relief was granted, there was a real risk of further transfer of the suit property to third parties, which could render the suit nugatory.
