The court found that while the Respondent had a valid reason for dismissing the Claimant based on his conduct, the termination procedure was flawed. The Respondent failed to provide the Claimant with adequate time to prepare and present his defence, thus breaching the procedural fairness requirements under Section 41 of the Employment Act. The disciplinary process was marred by insufficient notice and a lack of substantive hearing, rendering the dismissal procedurally unfair. Consequently, the Claimant was entitled to compensation for unfair dismissal and payment in lieu of notice, but not to the other claimed allowances and benefits, which were either unproven or already settled.
