Procedural Posture

Criminal Revision / Ruling on Application for Concurrent Sentence

  1. 1 Whether the trial court erred in ordering the applicant's sentences to run consecutively instead of concurrently.
  2. 2 Whether the applicant's custodial sentence should be commuted to the period already served.

Ratio Decidendi

The court found that although the trial court had jurisdiction and properly exercised its discretion in imposing consecutive sentences, the applicant had demonstrated remorse, rehabilitation, and had pleaded guilty, thereby saving judicial time. Given the passage of six years since conviction and the applicant's efforts at reform, the court determined that he had been sufficiently punished. The custodial sentence was therefore commuted to the period already served, and the applicant was ordered to be released unless otherwise lawfully held.

Court Disposition

application allowed; custodial sentence commuted to period served; applicant released unless otherwise lawfully held

Orders

  • The applicant's custodial sentence is commuted to the period served.
  • The applicant is ordered set at liberty and released from prison forthwith unless otherwise lawfully held.
