Procedural Posture

Notice of Motion / Ruling on Application for Change of Advocates, Stay of Execution, and Extension of Time to Appeal

  1. 1 Whether the plaintiff should be granted leave to change advocates.
  2. 2 Whether the plaintiff has provided sufficient reason for the delay in filing the notice of appeal and should be granted extension of time to appeal.
  3. 3 Whether a stay of execution of the decree should be granted pending appeal.

Ratio Decidendi

The court found that the plaintiff failed to act as a diligent litigant by not following up on the progress of his case for over one and a half years after testifying. The explanation provided for the delay in filing the notice of appeal was deemed unreasonable and unsupported by evidence. The court held that allowing the extension of time would prejudice the defendant by causing further delay in the satisfaction of the judgment. Consequently, the court only granted the prayer for change of advocates and dismissed the prayers for stay of execution and extension of time to appeal, awarding costs to the defendant.

Court Disposition

Application partly allowed; only the prayer for change of advocates is granted. All other prayers are dismissed with costs to the defendant.
