Ratio Decidendi

The court found that the parties and the cause of action in the present suit are the same as those in Nairobi ELC. No. 1078 of 2015 (Machakos ELC. No. 62 of 2017). The Plaintiff and her advocate were aware of the existence of the earlier suit before filing the present one. Section 6 of the Civil Procedure Act expressly prohibits the filing of a suit where another suit involving the same parties and subject matter is pending. The court held that the filing of the present suit was contrary to the law and constituted an abuse of the court process. Consequently, the court struck out Machakos ELC. No. 236 of 2015 with costs to the 1st Defendant.
