  1. 1 Whether the plaintiff, as chairman of the Land Disputes Tribunal, was immune from criminal prosecution under Section 15 of the Penal Code.
  2. 2 Whether the criminal proceedings and conviction in Malindi Chief Magistrate’s Court Criminal Case No. 1666 of 2007 were null and void.
  3. 3 Whether the plaintiff is entitled to special and general damages for prosecution and conviction.

Ratio Decidendi

The court found that Section 15 of the Penal Code and Article 160(5) of the Constitution provide judicial immunity only for acts done in good faith within the lawful performance of judicial functions. The plaintiff, as chairman of the Land Disputes Tribunal, was convicted of forgery—an act found to be criminal in nature and outside the scope of his judicial functions. Therefore, he was not entitled to immunity from prosecution. The court further held that the plaintiff failed to prove entitlement to special or general damages, as his prosecution and conviction were lawful. Consequently, all prayers sought in the plaint failed and the suit was dismissed with costs to the defendant.

Court Disposition

Plaint dismissed with costs to the defendant.
