The court held that it is not appropriate to transfer the suit from the Chief Magistrate’s Court to the Environment and Land Court before the lower court has determined the issue of its own jurisdiction, particularly regarding the constructive trust claim. The lower court should be given the opportunity to address the jurisdictional objection first. Transferring the suit at this stage would prejudice the Respondent and deny the lower court the chance to develop jurisprudence on the matter. Therefore, the application for stay and transfer was found to be unmeritorious and was struck out with costs.
