The court exercised its discretion under section 79G of the Civil Procedure Act, giving the applicant the benefit of doubt regarding the delay, and granted leave to file the memorandum of appeal out of time. However, the court awarded costs of the application to the respondent, acknowledging the delay was not fully justified.
