Ratio Decidendi

The court found that LR Ngandori/Kiriari/501 was never owned by the deceased but by his father, and was transferred to two sons of the 1st house by the grandfather, not the deceased. Therefore, it does not form part of the deceased's estate and cannot be considered a prior benefit under section 42 of the Law of Succession Act. The only property forming the estate is LR Ngandori/Kiriari/1416. As the deceased died intestate and had two houses, section 40 of the Law of Succession Act applies, requiring the estate to be distributed equally among all children of both houses, without discrimination. There was no evidence that any house or child had received a gift inter vivos from the deceased....
