Ratio Decidendi

The court held that the sale of the six acres of agricultural land was a controlled transaction under the Land Control Act and, lacking the requisite consent of the Land Control Board within the prescribed period, was void for all purposes. Consequently, the plaintiff's claim for specific performance could not succeed. The plaintiff was, however, entitled to recover the purchase price paid as a debt under Section 7 of the Act, but not for improvements or mesne profits, following established case law. The court dismissed the action with costs, ordering repayment of the purchase price deposited in court to the plaintiff and requiring the plaintiff to vacate the land.
