The failure to consider these documents was an oversight and constituted an error apparent on the face of the record. Under Order 45 Rule 1, such an error is a valid ground for review. The Court held that the requirements of Order 9 Rule 9 were satisfied by the filing of the consent, making the firm of Kimwere & Co. properly on record for the Defendant/Applicant. Consequently, the orders issued on 30/1/2020 were set aside, and the application was allowed in the interests of justice.
