Ratio Decidendi

The court found that the respondent, despite being aware of the lower court's judgment, had refused to surrender the original title deed, thereby frustrating the implementation of the decree. The court exercised its inherent powers under the Civil Procedure Act to facilitate the enforcement of the judgment by ordering the Land Registrar to dispense with the production of the original title deed and to proceed with registration of the applicants as per the judgment in Meru C.M. LDT 5/2006. The application was unopposed, and the court found no reason to deny the orders sought. Costs were awarded to the applicants as the successful parties.
