Ratio Decidendi

The court held that the Land Disputes Tribunal acted without jurisdiction in determining issues relating to title to land and family trust, as such matters are expressly excluded from the tribunal's mandate under section 3(1) of the Land Disputes Tribunals Act. The tribunal's award, which ordered subdivision of the suit premises and allocation of a portion to the respondent, was therefore a nullity. The court further held that jurisdiction cannot be conferred by consent, acquiescence, or estoppel, and may be challenged at any stage.
