The court held that the Land Disputes Tribunal acted without jurisdiction in determining issues relating to title to land and family trust, as such matters are expressly excluded from the tribunal's mandate under section 3(1) of the Land Disputes Tribunals Act. The tribunal's award, which ordered the subdivision of the suit premises and allocation of a portion to the respondent, was therefore null and void ab initio. The court further held that jurisdiction cannot be conferred by the parties' consent, participation, or estoppel, and can be raised at any stage of proceedings.
