Criminal Appeal / Judgment

  1. 1 Whether the sentence of twenty years imprisonment for grievous harm was harsh and excessive in the circumstances.
  2. 2 Whether the trial court properly considered the appellant's mitigation and mental health status when imposing sentence.

Ratio Decidendi

The court found that while the sentence of twenty years imprisonment for grievous harm was within the legal maximum of life imprisonment, it was manifestly harsh and excessive given the appellant's status as a first offender, the mitigation offered, and the circumstances of the case. The trial court had considered the appellant's mental health and mitigation, but failed to compare the sentence with those imposed in similar cases, resulting in a disproportionate outcome. The appellate court therefore set aside the twenty-year sentence and substituted it with a term of fifteen years imprisonment, to run from the date of arrest.
