The trial magistrate erred by not specifying whether the sentences were to run concurrently or consecutively. The appellant had already served 4½ years in prison, and the court determined that the sentence imposed should be set aside and substituted with the term already served. The appellant was ordered to be released unless otherwise lawfully held.
