Ratio Decidendi

The court found that the Respondent failed to comply with the mandatory conditions for redundancy under Section 40 of the Employment Act, including giving adequate notice, fair selection, and payment of terminal dues. The Respondent did not provide evidence of payment of the Claimant's terminal benefits. As a result, the termination was both substantively and procedurally unfair. The Claimant was therefore entitled to compensation equivalent to twelve months’ salary, as well as other terminal dues including notice pay, leave pay, severance pay, salary for days worked, overtime, travelling and baggage allowances. The claim for public holidays was dismissed for lack of proof.
