Procedural Posture

Environment and Land Appeal / Ruling on Withdrawal and Costs

  1. 1 Whether the 1st Respondent is entitled to costs upon withdrawal of the appeal by the Appellant.
  2. 2 Whether any Respondent is entitled to costs where the appeal was withdrawn before service or mapping into the efiling system.

Ratio Decidendi

The court found that the 1st Respondent and other Respondents were not entitled to costs because they had not been served with the memorandum of appeal and were not mapped into the efiling system at the time the notice of withdrawal was filed. The 1st Respondent's counsel could not have taken instructions or incurred costs in a matter of which he was not aware. The Appellant's affidavit provided a credible chronology showing that the withdrawal occurred before any Respondent was notified or involved. The Respondents did not provide any evidence to counter this. Therefore, no costs were awarded to the Respondents.

Court Disposition

Appeal withdrawn; no order as to costs.

Orders

  • There will be no costs to the Respondents.
