Legal Issues
- 1 Whether the appellant misrepresented himself as a Telkoms employee to obtain money by false pretences.
- 2 Whether the conviction was safe based on the evidence presented.
- 3 Whether the sentence of 18 months imprisonment was appropriate given the prevalence of the offence.
Ratio Decidendi
The court found that the prosecution had overwhelmingly proved that the appellant misrepresented himself as an employee of Telkoms to PW5 and obtained KES 500 under the pretext of installing a telephone line. The evidence was sufficient to sustain the conviction for obtaining by false pretences. Given the prevalence of such offences in the area, the court upheld the deterrent sentence of 18 months imprisonment. The appeal was dismissed in its entirety as both conviction and sentence were found to be proper and justified.
Court Disposition

Orders

JUDGMENT:
It was overwhelmingly proved that the appellant misrepresented himself to PW5 that he was an employee of Telkoms and thereby got shs.500/= under the pretext that he would install a telephone line for PW5.
Accordingly conviction on that count is safe and the appeal against it is dismissed. The offence is prevalent in this area and therefore I uphold the deterrent sentence of 18 months imprisonment meted out to this appellant. It means that the appeal is dismissed in its entirety.
