The court noted that the applicant's interest in the land was at risk due to the defendants' threats to dispose of the property, and that damages would not be an adequate remedy. Applying the principles in Giella v Cassman Brown, the court concluded that the balance of convenience favoured the grant of a temporary injunction to preserve the status quo pending the hearing and determination of the suit.
