The Court of Appeal found that the minutes of the Town Planning & Housing Committee dated 21st April 1981 constituted a valid public document, properly certified by the Nyambene County Council in 2000. The court held that the presumption of authenticity under Section 96 of the Evidence Act applied, as the document was over 20 years old and produced from proper custody. The appellant failed to prove that the minutes were a forgery or that no such meeting took place. The court further found that the evidence established the appellant sold Plot 341 “C” to the respondent for Ksh. 8,000, witnessed by two individuals, and that the transaction was duly approved and recorded in the committee...
