Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant was unfairly dismissed from employment.
  2. 2 Whether the claimant is entitled to reinstatement or compensation.
  3. 3 Whether the respondents followed due process in the disciplinary proceedings.

Ratio Decidendi

The court found that the claimant provided sufficient evidence to justify her absence from work, while the respondents failed to prove the allegation of falsified academic documents. The respondents did not follow due process in the disciplinary proceedings, particularly in failing to provide the claimant with a fair hearing before her final dismissal. As a result, the termination was deemed unfair under Sections 43 and 45(2) of the Employment Act. The court held that reinstatement was not appropriate due to the strained relationship between the parties and instead awarded the claimant compensation equivalent to three months' gross salary, plus costs.

Court Disposition

Claim partly allowed. Termination declared unfair. Reinstatement denied. Compensation and costs awarded.

Orders

  • The respondent shall pay the claimant compensation equivalent to three months' gross salary.
  • The respondent shall pay the claimant's costs.
