Procedural Posture

Claim / Judgment

  1. 1 Whether the respondent is liable to repay the principal loan amount advanced by the claimants on behalf of Mosiabano Self Help Group.
  2. 2 Whether the interest rate of 10% per month claimed by the claimants is enforceable or unconscionable under public policy.
  3. 3 Whether the claimants are entitled to costs and at what rate of interest.

Ratio Decidendi

The tribunal found that the claimants had proved, on a balance of probabilities, that the respondent borrowed Kshs. 10,000 from Mosiabano Self Help Group and failed to repay it. While the claim was unchallenged, the tribunal declined to enforce the contractual interest rate of 10% per month as it was unconscionable and against public policy. Instead, the tribunal awarded interest at the ordinary court rate of 14% per annum from the date of borrowing until payment in full. The respondent was also ordered to pay the costs of the claim, assessed at Kshs. 5,000.

Court Disposition

Judgment for the claimants for Kshs. 10,000 with interest at 14% per annum from the date of borrowing until payment in full, plus costs of Kshs. 5,000.

Orders

  • The respondent shall pay the claimants Kshs. 10,000.
  • Interest at 14% per annum from 2nd December 2016 until full payment.
