The tribunal found that the claimants had proved, on a balance of probabilities, that the respondent borrowed Kshs. 30,000 from the group and failed to repay it. Although the claim was unchallenged, the tribunal scrutinized the interest rate of 10% per month and found it unconscionable and against public policy. The tribunal declined to enforce the contractual interest rate and instead awarded interest at the ordinary court rate of 14% per annum from the date of borrowing until payment in full. The respondent was also ordered to pay the costs of the claim, assessed at Kshs. 10,000.
