Ratio Decidendi

The tribunal found that the claimants had proved their entitlement to the principal loan amount of Kshs. 10,000 on a balance of probabilities, as the respondent neither appeared nor rebutted the evidence. However, the tribunal declined to enforce the contractual interest rate of 10% per month (120% per annum) as it was unconscionable and against public policy. Instead, the tribunal awarded interest at the ordinary court rate of 14% per annum from the date of borrowing until full payment. The respondent was also ordered to pay the costs of the claim, assessed at Kshs. 5,000.
