The Court found that the Communication Workers Union has an associational interest in the outcome of the dispute because the Claimant's employment was governed by a Collective Bargaining Agreement co-authored by the Union and the Respondent. The Union's participation is not limited to being a witness, as it has a direct interest in the interpretation and application of the CBA and in the employment relations of its members. The Court held that denying the Union the right to participate would be contrary to the principles of fair labour relations and the associational rights of trade unions. Therefore, the application to amend the Statement of Claim to enjoin the Union was allowed.
