Ratio Decidendi

The court found that the judgement and decree dated 25/2/2021 merely dismissed the applicant's suit and did not require any party to do or abstain from doing anything, nor to pay any sum of money. As such, it was a negative order incapable of execution. Established legal principles and case law dictate that only positive orders can be stayed. Since there was nothing arising from the judgement for the court to enforce or restrain by injunction, no stay of execution could properly issue. The application for stay was therefore without merit and was dismissed with costs to the respondent.
