Ratio Decidendi

The High Court of Kenya lacks jurisdiction to register a judgment from the Royal Court of Jersey because Jersey is not listed as a reciprocating country under the Foreign Judgments (Reciprocal Enforcement) (Extension Of Act) Order, 1984, nor has any extension been granted under Section 13 of the Act. The court found that, regardless of the merits of the applicant's claim or the adequacy of service, the absence of statutory reciprocity is fatal to the application. The court therefore dismissed the application for registration of the foreign judgment for want of jurisdiction.
