Ratio Decidendi

The court found that the dispute concerns ownership of land, and therefore, jurisdiction properly lies with the Environment and Land Court (ELC) as per the Environment and Land Court Act, 2011. The failure to transfer the matter to the ELC when that court was established was an honest mistake. Although courts have recently been reluctant to transfer such matters due to the long-standing existence of the ELC Act, the court exercised discretion in this case, finding it just and prudent to transfer the matter to the ELC Kajiado for hearing and determination. The court ordered the Deputy Registrar to transmit the file to the ELC Kajiado for further directions.
