The High Court found that the trial magistrate erred in holding that there was no connection between Nairobi HCCC No. 311 of 2011 and the respondent's declaratory suit, as both arose from the same accident involving the same motor vehicle and parties. The court held that the magistrate failed to appreciate the relevance of the High Court suit to the issues in the declaratory suit. However, since the appellant had already filed a defence in the trial court, there was no prejudice in allowing the defence to remain on record, as amendments could be made later if necessary.
