Ratio Decidendi

The court found that the application for judicial review orders had been overtaken by events due to the gazettement of the Party List for Kiambu County Assembly. In line with the Supreme Court's decision in Moses Mwicigi & 14 others v IEBC & 5 others, the court held that the IEBC's mandate ends upon gazettement, and any disputes thereafter must be addressed in the Election Court. Consequently, the main application was allowed to be withdrawn, and the Interested Parties' application, being dependent on the main application and seeking to restrain an act already completed, was dismissed. Each party was ordered to bear its own costs.
