The Court of Appeal held that the vetting of judges and magistrates by the Judges & Magistrates Vetting Board (JMVB) is a transitional mechanism intended to address conduct up to the effective date of the Constitution of Kenya, 2010 (27th August 2010). The Court found that the relevant constitutional and statutory provisions, when interpreted contextually and purposively, restrict the JMVB's mandate to complaints arising or pending before the effective date. Complaints arising after the effective date fall exclusively within the jurisdiction of the Judicial Service Commission, as provided by Articles 168 and 172 of the Constitution.
