1. Upon perusing the pleadings in this case, I find that the parties in this case come from Bomet County and the properties herein known as KERICHO/KAPLETUNDO/CHEMAGEL/BLOCK 1/44 and KERICHO/KAPLETUNDO/CHEMAGEL/ BLOCK 1/45 are also situated in Bomet County.
2. There is also evidence that there is another case pending before Bomet High Court involving the same parties and on the same subject matter being Bomet High Court Civil Suit No.E002 of 2021 – JULY CHEPTOO LABOSO -VS- MARY CHEPKIRUI LABOSO and 2 OTHERS
3. This file be and is hereby transferred to Bomet High Court for disposal.
4. The Deputy Registrar of this court to forward this file to the Deputy Registrar at the Bomet High Court for purposes of taking a date before the Bomet Judge for directions.
