The Tribunal held that, in the absence of a valid agreement requiring landlord's consent for change of business and without proof of rent arrears, the notice to terminate was invalid. The Tribunal therefore declared the landlord's notice to terminate tenancy of no effect and allowed the tenant's reference with costs.
