The court found that the Chuka Senior Principal Magistrate's Court lacked jurisdiction to hear and determine the succession cause because the value of the estate exceeded the statutory limit of Kshs. 100,000 for magistrate courts under Section 48(1) of the Law of Succession Act. The grant was issued to the 1st petitioner alone, and the subsequent inclusion of the 2nd petitioner, who was not a beneficiary or dependent but a purchaser, was contrary to Sections 58(2) and 66 of the Act.
