The court found that there was a procedural mix-up in the handling of two separate appeals: one relating to Murang'a Succession Cause No. 193 of 1990 (Julia Nyambura Macharia v Patrick Gichuki Gachiri) and another relating to Thika Succession Cause No. 447/05 (Bernard Waweru Githinji v Githinji Hacho). The record of appeal and original file for the Thika matter had been erroneously merged with the Murang'a appeal file. As a result, the preliminary objection raised in respect of the Thika matter could not be determined in the current proceedings, as the memorandum of appeal for that matter was not properly before the court.
