Neither party has obtained letters of administration, and thus neither has legal capacity to institute proceedings concerning the estate. The court, exercising its inherent powers, directs the parties to file appropriate succession proceedings in the Family Division within 21 days and orders that the status quo be maintained in the interim. The Plaintiff's suit is stayed pending the outcome of the succession proceedings.
