Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the claimant's employment was for a valid reason and effected in terms of a fair procedure.
  2. 2 What remedies, if any, the claimant is entitled to.

Ratio Decidendi

The court found that the respondent failed to prove that the claimant was terminated for a valid reason and did not follow a fair procedure as required by law. The respondent did not provide evidence of disciplinary hearings or minutes, nor did it give the claimant an opportunity to respond to the allegations. The court held that the termination was both substantively and procedurally unfair under Sections 41, 43, and 45 of the Employment Act, 2007. Consequently, the claimant was entitled to compensation for the unexpired term of her contract and one month salary in lieu of notice.

Court Disposition

Judgment for the claimant.

Orders

  • The respondent shall pay the claimant Kshs 25,000 in lieu of notice.
  • The respondent shall pay the claimant Kshs 225,000 as compensation for unlawful and unfair termination.
