The court found that the Defendants had demonstrated a risk of substantial loss if evicted from the suit property before their intended appeal was heard, as they were in possession and eviction would disrupt their lives and basic necessities. The application for stay was filed within a reasonable time. The court exercised its discretion to grant a stay of execution to preserve the status quo and ensure the appeal, if successful, would not be rendered nugatory. However, the court declined to grant an order for maintenance of status quo in the form of an inhibition, as such an order was not canvassed in the main suit and the Defendants' claim for adverse possession would not be prejudiced...
